Akhwat Akwop - Christian extremist group threatens retaliation against Boko Haram !!

Akhwat Akwop A new Christian terror group in the North formed apparently to counter the activities of the Notorious Boko Haram sect and has sent warning signals to five Islamis countries alleged to be sponsors and supporters of Boko Haram.

Akhwat Akwop claimed that Saudi Arabia, Sudan, Islamic Republic of Iran, Syria and Mauritania warning that it will attack the interest and Nationals of these Countries.

The group made their position known to the media yesterday in Kaduna, Abuja and Lagos. The groupd sounded a wakeup call to Christians all over the country stressing that Boko Haram’s activities is political and a ploy to intimidate President Goodluck Ebele Jonathan and other stake holders to enable Hausa/Fulani seize power in 2015 and added that Political power must return to the old eastern region after Jonathan in 2015.

Akhwat Akwop came into the security radar about two months ago when it started dropping leaflets with its inscriptions in some part of the north, including Adamawa,Bauchi, Benue ,Borno,Kogi,Nasarawa , Taraba, Plateau and Yobe states, warning that it would do everything within its power to liberate the northern Minorities from the strangle- hold of Hausa/Fulani. Who it stated has been oppressing them in the name of Islam in the north.

Large quantities of the leaflets were left at the state chapter of the Nigerian Union of journalists in Kaduna state.

The leaflets , warns that Akhwat Akwop stands for the Christians equivalent of the Boko Haram sect saying that it will actively engage in the battle to liberate the northern minorities whether Muslim or Christians

D’Banj’s fans has been dazed by by the report that he and his soul brother of the Mohits had been arrested by local authorities in the United States of America for alledged drug trafficking.

The “gist” was so “stunning” that it shows that the Mohits guys were apprehended “ a day after the FBI got an anonymous tip that the Nigerian duo were arriving the JFK airport “loaded” .

“About 100 kilos of substance suspected to be cocaine was recovered from their luggage and the Nigerians are currently being detained by the FBI pending further investigations and subsequent court hearing” an online entertainment website added.

This claim had been debunked by Don Jazzy’s tweet on Twitter saying “If D’banj was caught with drugs in Yankee that one mean say for a trip from Ghana to Lagos you need to transit in New York abi? Osheee lol “.

In other words, it was just another wicked rumour!! Rumours like this had been rampant concerning Nigerian celebrities in the Music and also Movie Industries apart from an isolated case of Wunmi a popular Yoruba actress who was convicted some years ago for drug trafficking most of the tales about celebrities being arrested for drug trafficking had been mere rumours. Most of the Rumours affecting D’Banj in the past had been positive , notably his love link with Nollywood star, Genevieve Nnaji.

National Human Rights Commission Submits gang -rape report to minister

The National Human Rights Commission on Tuesday in Abuja said it has submitted its report to the minister of youth Development, Mr Bolaji Abdullahi having concluded investigation into the gang-rape of a female student.

The commission urged the Nigerian police to “conclude their own investigations as soon as possible and arraign the suspects before a court of competent jurisdiction

The commission had earlier met recently with the Minister of Police Affairs, Navy Capt. Caleb Olubolade (retd), and urged him to direct the police to investigate the matter.

A statement by the NHRC’s Director of Public Affairs and Communication, Mr. Muhammad Ladan, quoted the Acting Executive Secretary, Mrs. Oti Ovrawah, as welcoming the progress recorded in the investigation of the gang rape.

.The Commission called for adequate police protection and a full medical examination of the victim, whom, it claimed, might have been exposed to sexually transmittable diseases and possible unwanted pregnancy.

The NHRC said, “Police protection and medical care for the victim as well as diligent prosecution of the suspects are critical issues to be addressed at this point. The gang rape is cruel, dehumanising and unacceptable. It is a primitive act of violence against womanhood and those involved in this dastardly and beastly act should be made to give a full account of their action.”

The NHRC also flayed the initial dismissive approach by the relevant authorities (namely the ABSU University Authourities and the Abia state Government) in the matter without a thorough investigation, describing it as “embarrassing.”

Opinion

The Investigation embarked on by the Nigerian Police on this matter should not take too long as to weaken the case against the suspects, everything should be done effectively to gather enough evidence in order to carry out a diligent prosecution, what majority of Nigerians are interested in is not only doing justice to this case but justice must be seen to have been done.

ABSU Gang rape case. will the victim get justice? A lawyer's analysis


By virtue of my profession as a legal practitioner , i will try and explain what we have on ground.

In the case before us and what we can deduce from the video clip, it appears to the objective mind that the Lady in the video has not consented to the act and she was been forced to continue because of fear of been harmed. there was also complete penetration which is a vital ingredient to prove that rape has occurred.
The problem is that it is not easy for the judge/court to just step into the arena and decide that having seen the video like Seun has stated , the suspects are hereby found guilty of the "Offence" the court does not work that way. the court acts and is limited to how well the prosecution conducts its case. Rape is a criminal offence and the burden of proof is on the prosecution to prove the offence and this must be proof beyond reasonable doubt.
The prosecution must conduct its case diligently for the expectation of the general public (especially the honorable laymen of the public) to be actualized.
The Victim must be identified and must also be willing to come out to the open to identify the suspects as those she had an encounter with on the fateful day,the identification of the scene of crime (location where the act took place) should also be identified.,she must be willing to aid the prosecution in their investigation. she must also be willing to testify against the suspects(accused) in the open court ,


The Prosecution's next hurdle once investigation is complete is to come to charge the accused to the open court , open its case, call its witnesses (Prosecution Witness(es) to testify in the open court , present the controversial video clip to the open court so as to establish its case that the act of rape actually took place and that there was penetration/ unlawful carnal knowledge and gross sexual assault. the prosecution will then seek to tender this as an exhibit in the open court. The prosecution then closes its case and the defense will open his own case in order to cast doubt on the prosecutions case. there are several options for the defense to adopt including a no case submission if it feels the prosecution's case is so bad that it will "self destruct"
What i am trying to say in essence is that securing a conviction depends on the strength of the prosecutions case and more importantly the diligence with which it is being carried out. and to some extent on how strong a defense lawyer can conduct the defence of the accused persons. Therefore if we must get justice we need competent lawyers sponsored by various interest groups to hold watching brief for the would be complainant in the course of trial.

Rape is the most serious kind of sexual assault and is punishable with imprisonment for life with or without whipping according to the Nigerian Criminal code.
The Offence is defined in section 357 of the Criminal Code as follows
" Any person who has unlawful carnal knowledge of a woman or girl ,without her consent,or with her consent,if the consent is obtained by force or by means of threat or intimidation of any kind,or fear of harm,or by means of false and fraudulent representation as to the nature of the act,or, in the case of a married woman,by personating her husband,is guilty of an offence which is called rape.
" Every person who does or omits to do any act for the purpose of enabling or aiding another person to commit the offence and every person who aids another person in committing the offence are all criminally responsible under section 7 of the Criminal code.
this includes the person making the video of the rape and possibly the owner/occupant of the apartment/room in which the offence was committed are also criminally responsible for rape , conspiracy to commit rape and facilitating the commission of the offence.

A national Youth service member, A lady serving with Durumi secondary school kurna in Kano was reportedly gang raped by some miscreants .

Abba Garba (18 years old) and Abubakar Suleiman (17 years old) have been arrested in connection to the crime.

The Incident occurred in one of the classrooms of the School at about 12 noon

The victim was not aware that there was a strike action had resumed for classes.

There was a heavy rain fall on the fateful day and the victim could not leave the school premises immediately, The miscreants happened to have chosen to take refuge in the school building as well to avoid the torrential downpour.

Garba , said they saw the lady who appears to be in her late twenties, that though they could not understand the Language she spoke to them, they were moved by her beauty , they threatened her with a sharp knife ordered her to undress and raped her in turn, unfortunately for them a police patrol team came and arrested the duo of Abba Garba and Abubakar Suleiman while the other two Ali Wara and Nazeephy Malam escaped and are now at large.

Source - Vanguard The life-affirming tale of Precious Donatus Ogbonna and her controversial babies is yet to be over as she has delivered another baby, the same way she delivered seven others bringing the number to eight in a space of 16 months, and about two months after she was released on bail from the prison custody

The so-called birth took place at 12:15 am Thursday, at Rose Natural Clinic, Afam Street, Heritage junction, beside Paradise International School, Afam, Oyigbo, Port-Harcourt, Rivers state. It was one of the places SaturdayVanguard had reported of carrying out mysterious deliveries. Precious is yet standing trial in court over child trafficking.

Her lawyer, Barrister B. E Nwigwe had written Vanguard informing it of the planned delivery and requested everybody to witness the process. He said he had also written the Police, the Court and NAPTIP to be part of the process. Among all these, only Vanguard was present at the place during the birth.

The reporter had arrived Owerri, Imo state on Tuesday, ahead of the planned delivery scheduled for Wednesday September 21, 2011.

She didn’t appear as an expectant woman, moving about with so much agility that no one could believe she was pregnant let alone about to deliver a baby. But she told Saturday Vanguard that the last time she went for antenatal at the same clinic, she was given September 21 as her delivery date.

She added: “the thing has been disturbing me since the last few months.” She said she chose the clinic against the conventional hospital because the hospitals did not see anything in her stomach other than fibroid, but Rose Natural Clinic, detected it was a baby and gave her an Expected Date of Delivery, EDD.

On Wednesday, the reporter travelled from Lagos to Owerri to join Precious and four other women who are members of her church in a commercial ITC bus to Port-Harcourt at about 1:15pm. We did not reach Port Harcout until about 4:10pm.

The stress of driving on the Aba-Port Harcourt road was phenomenal, exacerbated by the bad road along Oyigbo, Aba road. It was the most deplorable road in the country. That also was enough to induce labour on a heavily pregnant woman passing through the road in a popular ‘Keke NAPEP’. We arrived the clinic at about 5:05pm and was joined by another Vanguard reporter based in Port-Harcourt.

There was no indication denoting an activity of such going in the environment. The only sign post in that area was erected at the Heritage Junction, about a kilometre from the house and it read Ogechi Natural Clinic. No other natural clinic was known in the neighbourhood.

It was a two- apartment bungalow. The first where the delivery took place was occupied by Nurse Rose for her activities. The large sitting room is used as the waiting room where guests and patients are received. There is a lobby by the right hand side of the waiting room which has a toilet and a room used as labour room.

There were three other middle aged women billed for delivery that evening. They all had a similar appearance which did not portray heavy pregnancy. After several hours of waiting, four tea-cups were passed around to the four ‘expectant women’. All the four women drank the substance in it which the nurse said would aid ‘labour.Few minutes later, she began walking around, exercising her body apparently to aid the ‘labour’. They were called in according to their turns.

Precious was the second in the list. She told Saturday Vanguard that she had been tested and that the nurse confirmed that she could feel the head of the baby and that she would be the second person on the list.

The first person had a baby girl about ten minutes after she was called in. Precious who went inside the ‘labour room’ about 11 25pm did not come out until 12: 15am. No one was allowed inside the labour room to witness the process, not even any of the female members of her church was allowed into the labour room. Precious had assured Saturday Vanguard that a third party would be allowed to witness the process in order to vindicate her, but the fair-skinned Nurse Rose objected, arguing that such a demand would not be made in a conventional clinic . She threatened that she would walk-out if Precious should insist. She entered the labour room all alone with Nurse Rose.

Right from the moment she entered, it was shouts of ‘Jesus’ and cries of pain. The cry rent the air so much that all the women in the waiting room began to pray. Ada Ngozi, her personal assistant who was arrested with her in June and recently got released on bail did not fail to show her dexterity as a prayer warrior. Eventually, when Nurse Rose finished with Precious, she asked whoever cared to come and see the baby. The baby was dressed up while other women took their turns in the delivery room. They all had baby girls and none of them breastfed their babies. From about 12:15 am till about 8:30am when we were with her, we observed that Precious’ baby was not breastfed nor fed in whatever way throughout our stay. The baby did not cry either. With this development, the issue of Precious controversial birth is yet unresolved.

Responding to questions after the delivery, Precious said she is satisfied and believes that she would be vindicated. On when she got the EDD, she said she was given the date recently when she went for check up at the same clinic. We gathered that Nurse Blessing in whose clinic she delivered five of her babies refused to handle her latest delivery with an alibi that she was on vacation and would only resume after the dedication of her baby in October.

Precious however told Saturday Vanguard that she had one of her babies in the same Rose Natural Clinic.

Asked to narrate what happened in the labour room, she said, “it was not easy, I almost collapsed. I didn’t even know that I was going to survive it. They said that the head of the baby was too big and she gave me a heavy cut. In the process, I had muscle pull which I had not experienced in life before. The baby wanted to die and the nurse asked me to co-operate .They had to beat me very well before God gave me the strength. I even vomited seriously. Whenever I wanted to push, I would vomit. They threatened to leave me if I did not co-operate.The pain was too much. It was hard a labour.

On the possibility of having more babies, since she had said in an earlier interview that God said she was going to have ten babies, we asked whether the nurse also detected more babies coming, she said: “No, the nurse did not tell me anything like that. Further conversation goes thus:

When did you conceive this baby?

It was the same conception. You will recall I told you I was feeling some kicks in my stomach in one of your interviews and this resulted into the baby.

So, are you still expecting more babies?

Ehm! I can’t say that for now, but if there is any development, I will let you know. I just put to bed now, I can’t say.

While you were shouting in the labour room, was the light off?

No, it was on. Before I went into the labour room, I called one of you to go and check if there was any thing hidden.

One of the four ladies who went with her to the clinic in Port Harcourt, Chidima Okorowu, Lolo of Eze Izonme community in Oguta local government area of Imo state, said: “Today I thank God that the truth has come to life. It is a divine work of the Lord. We travelled together, and when we got to the clinic, Rose Natural Clinic, there were other expectant women. It was a prolonged pregnancy, but God used the woman to deliver her. It was also a prolonged labour, we were all panicking, but God intervened. The woman in the process went into a coma before she was injected and resuscitated.”

Given these circumstances, Lolo, Chidinma said she believes the process and that Precious truly gave birth to the baby. “Under these cicumstances, I think people should believe her because I saw that she passed through painful and prolonged labour. Before she entered, I saw that water came out of her body and after the baby came out, I saw when the umbilical cord and placenta were cut.”

August 25 2009, Amarachi (died after five days); second baby, May 6, 2010 (Conqueror, female); third baby, June 3, 2010, (Chizitere, female); fourth baby, August 16, 2010 (Ekpereamaka, male); fifth baby, September 19, 2010, (Fineseed Angel, female); sixth baby, October 19, 2010 (Evidence, female); seventh baby, January 13, 2011,( Flourish, male), eight baby, April 2, 2011, (Ebenezer, male) . Now the eighth baby, September 21, 2011, named Hero Delight Chimedere (God wants me to live)

ABSU Gang rape-Nigeria Police arrests two people !!






According to Abia state commissioner of Police Bala Abdullahi Hasan, Two men has been arrested in connection with the gang rape video of a woman posted on the internet after ace cyber activist posted pictures and names online .

The controversial video clip has infuriated many concerned citizens of Nigeria due to the brutal nature of the rape and the failure of the police and government agencies to investigate. Since the faces of the men did not appear on the tape chances of apprehending them seemed very little.

Despite the video of the gang rape being widely watched on the internet with a record 1.5 million downloads, the Government officials and police in Abia state labeled the video clip a hoax and were rather interested in stating that the event did not occur in the School or in the state, the police even went further to state that they don't investigate cases based on internet reports more so the victim has not come forward. Governor Theodore Orji’s aides, Chief Eze Chikamnayo, Special Adviser on Information and Strategy and Mr. Ugochukwu Emezue, Special Adviser on Electronic Media, dismissed the video clips as a “contraception of some idle people”, saying “it is so ridiculous that people believe this”.

After sustained campaign on social networks, web blogs and pages of Newspapers by many organizations the police were forced back into action and to uncover clues from the video that might identify the culprits.

The National Assembly on Thursday called on the Nigerian police to re-open there investigations

Yesterday the pictures of suspects were posted by through the investigative journalists .Two of the suspects whose pictures were posted on the internet has now been arrested by the Nigerian police. however contrary to the BBC report that arrests made were based purely on what was posted on the internet, the minister of youth development had already announced that one of the suspects had been identified conclusively unconfirmed reports says that the rape took place and was video recorded at "Marantha logde" a student hostel , off - ABSU campus .

The rape victim might also have been identified as it appears she had come forward, a women's rights group has said they are now in touch with her and are trying to get her out of Abia State to where she can receive counseling and medical attention.

The way the authorities attempted to handle this high profile case shows the extent of decay and the need to re-engineer the whole justice enforcement/delivery system in Nigeria.

ABSU Gang rape suspects identified - The Legal Implication !!






The Minister of youth Development Mallam mobolaji Abdulahi earlier said today that in-spite of the identification of the suspect of the ABSU Gang rape it may be difficult to bring them to book on the charge of rape. He was quoted to have said
" Some legal expert have told us that it may be difficult to convict the rapists because the video does not reveal the faces of the victims (suspects i believe he meant to say) The girl is not a student of Abia state university she was raped in an off- campus residential area of the students .one of them (suspects) has been identified conclusively. Although the faces of the rapists are not seen in the video, the minister said the National Human Rights Commission was on top of the situation.“The National Human Rights Commission is working with the Ministry of Youth Development. The commission, which is headed by a competent lawyer, is on top of this case.“This is law, if we can not press for violation, there are other charges that we can press. I can assure you that justice will be done.”

Now lets make an attempt to solve this puzzle logically and as a legal practitioner . i have worked at the National Human rights commission and i know how the system works. In the video, the girl’s face is clearly seen but the faces of the five boys remain blurred. One could clearly hear them speak Igbo and English language revering to each other by names; for instance, one of the rapists said, “Wisdom don dey talk now.” Other names the rapists called themselves during the commission of the act in the video include: Chisom, Zaki, Uchenna. Zaki even bragged to the victim, “Do you know who Zaki is?” The fifth name is a little muffled but sounded very much like Ifeanyi. One of them identified himself as a 400 level law student, while another claims to be on IT Industrial attachment.
The first thing to do is to ensure that the identifies suspects(s) are questioned and interrogated (of course they are at liberty to deny their involvement especially with the aid of a very good lawyer. The identification of Lady /Victim (in person) in the video is very important to prove its case against the suspects , she will be in a perfect position to identify the suspects and the location of the crime which will also be very helpful to the prosecution.
An important step the government can take now is to openly appeal to the victim to come forward and help bring the suspects to book. it is quite unfortunate that most rape victims would rather keep quiet and suffer the trauma in silence as they are afraid for stigmatization from the public if they ever come forward with their testimonies.luckily the only face that appears clearest on the video is that of the victim and it will be a shame if the Nigerian security agencies lacks the intelligence to identify the victim in person.

The names of possible suspects and pictures in circulation at the moment are as follows :
1 Ifeanyi Justin Ogu
2. Jonah Uche (final or extra year accountancy)
3. Zaki (resides in Duberville Lodge, ABSU)
However only one suspect has been identified “conclusively” according to The Minister of youth Development Mallam mobolaji Abdulahi.
The Controversial gang rape video has gone viral on the internet and has a record of close to 1.4 million downloads (and still counting).
Another thought provoking statement is "i hope the victim of the crime has not been murdered" this is a very important statement to be further warrant a serious investigation into this matter as the culprits can go to any length to cover up their crime.
